Important: These Terms & Conditions have been drafted based on the operational details of the Goo Ai application. They should be reviewed by qualified legal counsel before publication.

1. Agreement to Terms & Eligibility

These Terms and Conditions ("Terms") govern your access to and use of the Goo Ai mobile application (also marketed as "Glowia") and any related services (collectively, the "Service"), operated by GooAI LLC ("Company," "we," "us," or "our").

By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Eligibility. You must be at least 13 years of age (or such higher minimum age as required by the laws of your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this agreement. If you are under the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Description of the Service

Goo Ai is a beauty and wellness mobile application that uses AI-powered technology to analyse skin characteristics from a facial photograph captured using your device camera. The Service currently includes:

Skin Analyze: Live camera capture with quality checks, photo review, scan plan selection (Quick, Essential, Advanced, or Full), credit-based analysis, and results including an overall skin score, skin age estimate, per-metric breakdown, story-style results with mask overlays, and a detailed AI-written summary with recommendations.

Coming soon (Beta / Not yet available): Virtual try-on features including Makeup, Hairstyle, Hair Color, Nail Art, Lip Color, Eyebrows, and Glasses. These features are not currently available and are subject to change.

The Service is available in English, Korean, and Mongolian. Features and availability may vary by region.

3. Account Terms

Anonymous accounts. When you first use the Service, an anonymous account is automatically created for you. You are assigned a unique identifier (UUID). No email address, username, or password is required to access core features. Your credits, scan history, and purchase records are associated with this anonymous identifier.

One account per user. You may not create multiple accounts or share your account with others. Each device/account combination is intended for use by a single individual.

Account security. You are responsible for maintaining the security of your device and any authentication session. If you delete the app or sign out, your anonymous account may not be recoverable. We are not responsible for any loss of data or credits resulting from account loss caused by device loss, factory reset, or app deletion without prior contact with our support team.

Account recovery. Because accounts are anonymous, recovery may not be possible. If you believe you have lost access to your account, contact us at info@itf.mn with your account UUID (found in app settings) or supporting purchase receipt information.

4. Acceptable Use

You agree that you will not:

Upload photographs of any person other than yourself without their explicit consent;
Use the Service to process images of minors below the minimum age set out in Section 1;
Attempt to reverse engineer, decompile, or disassemble any part of the app or its underlying technology;
Attempt to circumvent, manipulate, or exploit the credit system, payment verification, or server-side controls;
Use automated tools, bots, or scripts to interact with the Service;
Use the Service for any illegal purpose or in violation of any applicable law or regulation;
Interfere with or disrupt the integrity or performance of the Service or its underlying systems;
Misrepresent the output of the Service as medical advice or a medical diagnosis to others;
Violate any third-party rights, including intellectual property rights, in connection with your use of the Service.

5. Credits, Subscriptions & Payments

5.1 Credit System

Skin scans consume credits. The number of credits deducted per scan depends on the selected scan plan:

Quick — lowest credit cost
Essential
Advanced
Full — highest credit cost

Credit balances are enforced server-side. Initiating a scan with insufficient credits is not permitted. Credits have no cash value and are non-transferable between accounts unless required by applicable law. We reserve the right to adjust credit pricing at any time with reasonable notice.

5.2 Credit Packs (In-App Purchases)

Credits may be purchased via in-app purchase through the Apple App Store or Google Play:

Prices are set in your local currency by Apple / Google and are subject to change.

5.3 Goo Ai Pro Subscription

We may offer a Goo Ai Pro subscription (entitlement ID: Goo Ai Pro) via RevenueCat, managed through the Apple App Store or Google Play. Details of what is included in Goo Ai Pro (versus credit packs) will be presented to you at the point of purchase within the app.

Auto-renewal: Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. You can manage and cancel subscriptions through your Apple ID or Google account settings.

Free trials: If a free trial is offered, any unused portion is forfeited when you purchase a subscription during the trial period.

5.4 QPay (Mongolia)

Where offered, credits may be purchased via QPay as an alternative payment method. QPay transactions are verified server-side before credits are granted. Payment credentials are never stored on the client device. QPay payments are subject to QPay's own terms and conditions.

5.5 Refunds

All purchases are processed by Apple or Google and are subject to their respective refund policies. We do not directly issue refunds for in-app purchases. To request a refund, please use the Apple or Google refund process:

Notwithstanding the above, nothing in these Terms limits your rights under applicable consumer protection law.

6. Intellectual Property

The Service, including all software, content, branding, design, logos, and trademarks, is owned by or licensed to GooAI LLC and is protected by intellectual property laws. "Goo Ai" and "Glowia" are trademarks and trade names of GooAI LLC.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the app on your personal device solely for your personal, non-commercial use in accordance with these Terms.

You may not copy, modify, distribute, sell, or lease any part of the Service, or attempt to extract the source code, except where expressly permitted by law or with our written consent.

7. User Content & Licence Grant

When you capture and submit a facial photograph through the Service, you retain ownership of that image. By submitting a photograph, you grant us a limited, non-exclusive, worldwide, royalty-free licence to process and transmit that image to our third-party analysis providers (including Perfect Corp / YCE) solely for the purpose of performing the requested skin analysis. This licence does not extend to use of your image for advertising, model training, or any other purpose unless explicitly disclosed to you and consented to separately.

You represent and warrant that:

The photograph you submit is of your own face;
You have the right to submit the photograph for this purpose;
Your submission does not violate any third-party rights or any applicable law.

8. Third-Party Services Disclaimer

The Service integrates with the following third-party providers: Perfect Corp / YouCam Engine (skin analysis), Google Gemini (AI-generated text), Supabase (backend infrastructure), RevenueCat (payment management), Apple App Store, Google Play, and QPay. Each provider operates under its own terms of service and privacy policy.

We are not responsible for the practices, availability, or content of third-party services. Outages or changes by third-party providers may affect the availability or accuracy of the Service.

9. Medical & Wellness Disclaimer

IMPORTANT — PLEASE READ CAREFULLY. Goo Ai is a wellness and cosmetic guidance application only. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease, medical condition, or skin disorder.

Results provided by the Service — including skin scores, skin age estimates, metric breakdowns, and AI-generated insights — are for informational and educational purposes only. They do not constitute medical advice, a medical diagnosis, or a recommendation for treatment.

AI-generated text may contain inaccuracies or errors. You should not rely solely on the output of this app for any health-related decision. Always consult a qualified dermatologist or healthcare professional regarding any skin concerns, conditions, or symptoms.

10. Disclaimers & Limitation of Liability

No warranties. The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

Analysis accuracy. Skin analysis results depend on photograph quality, lighting conditions, device camera capabilities, and the accuracy of our third-party analysis provider. We make no guarantee regarding the accuracy, completeness, or reliability of analysis results.

Limitation of liability. To the fullest extent permitted by applicable law, GooAI LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service, including but not limited to loss of data, loss of credits, or reliance on app output, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising under these Terms shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) USD $10.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability, so the above limitations may not apply to you in full.

11. Indemnification

You agree to indemnify, defend, and hold harmless GooAI LLC and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service in violation of these Terms; (b) your submission of photographs that infringe third-party rights or applicable law; or (c) your violation of any applicable law or regulation.

12. Termination

By you. You may stop using the Service at any time by deleting the app from your device. Deletion does not automatically delete your anonymous account or data from our servers; contact info@itf.mn to request account deletion.

By us. We reserve the right to suspend or terminate your access to the Service at any time if you violate these Terms or if we determine, in our sole discretion, that your use is harmful to the Service or other users. In such cases, unused credits are forfeited except where required otherwise by applicable law.

Effect of termination. Active subscriptions managed through Apple or Google will continue until the end of the current billing period; refunds (if any) are subject to Apple's or Google's policies. Purchased credit packs have no refund value upon termination for cause.

13. Dispute Resolution & Governing Law

These Terms are governed by and construed in accordance with the laws of Mongolia, without regard to its conflict of law principles.

Any dispute arising out of or in connection with these Terms or the Service shall first be attempted to be resolved by good-faith negotiation between the parties. If not resolved within 30 days, disputes shall be submitted to the courts of competent jurisdiction in Mongolia, and you consent to personal jurisdiction in such courts.

Notwithstanding the foregoing, nothing in these Terms prevents you from asserting your rights under applicable consumer protection law in your country of residence.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Effective Date" at the top of this page and, where appropriate, through an in-app notice. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes.

If you do not agree to the revised Terms, you must stop using the Service and may request deletion of your account by contacting info@itf.mn.

16. Apple & Google Platform Clauses

16.1 Apple-Specific Terms (iOS)

If you downloaded the Service from the Apple App Store, the following additional terms apply:

Apple is not a party to these Terms. These Terms are between you and GooAI LLC only, not with Apple Inc. ("Apple"). Apple has no obligation whatsoever to furnish maintenance or support services with respect to the Service.
Scope of licence. The licence granted to you is a limited, non-transferable licence to use the Service on any Apple-branded product you own or control, as permitted by the App Store Usage Rules set forth in the Apple Media Services Terms and Conditions.
Warranty. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Service to you (if applicable). To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the Service.
Product claims. GooAI LLC, not Apple, is responsible for addressing any claims you or any third party may have relating to the Service or your possession and/or use of the Service, including but not limited to: (i) product liability claims; (ii) any claim that the Service fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
Subscriptions. Goo Ai Pro subscriptions (if offered for iOS) are managed through the Apple App Store. Refunds for subscriptions are handled by Apple in accordance with Apple's policies.

16.2 Google-Specific Terms (Android)

If you downloaded the Service from Google Play, your use of the Service is also subject to Google Play's Terms of Service. Subscriptions and in-app purchases for Android are managed by Google Play and RevenueCat. Refunds are subject to Google Play's refund policies.
